[Isabelle Futsi Isabelle Futsi, LMFT (Marriage & Family Therapist #102306) d/b/a Futsi Therapy] (“Futsi Therapy,” “our,” “us,” or “we”) is committed to protecting the privacy and security of the information of our website visitors and patients. We want you to understand how we collect and use information from our website, futsitherapy.com (the “Platform”), and through offering our telehealth and care services (each a “Service” and together with the Platform, the “Services”) so you can interact with Futsi Therapy and our providers with confidence. By using the Services, you accept and agree to the practices this Privacy Policy describes.
Futsi Therapy’s Notice of Privacy Practices is a separate document that governs how medical information about you may be used and disclosed by Futsi Therapy in connection with the Services and Platform all in accordance with the Health Insurance Portability and Accountability Act and its implementing regulations (“HIPAA”). In addition, any medical or health information that you provide that is subject to specific protections under applicable state laws will be used and disclosed only in accordance with such applicable law.
When you use our Services, we may receive protected health information, and we may collect, use, and disclose other personally identifiable information. Under HIPAA certain demographic, health, and/or health-related information that Futsi Therapy receives as part of providing the Services may be considered “protected health information” or “PHI.” HIPAA provides specific protections for the privacy and security of PHI and restricts how PHI is used and disclosed. If applicable, Futsi Therapy may only use and disclose your PHI in the ways permitted by our agreement with your health care provider, as authorized by you or otherwise in compliance with HIPAA. In addition, “personally identifiable information,” as used in this Policy, is information that specifically identifies an individual, such as an individual’s name, address, telephone number, e-mail address, or other similar information that can be used to identify you. Personally identifiable information also includes information about an individual’s activity on our Services, including profile information and other identifiable information entered by you. PHI and personally identifiable information are collected and referred to in this Policy as “Information.”
What Information Do We Collect?
When you use our Services, we may collect and use your Information as well as other non-individually identifiable information. To participate in certain features of the Services, you may be required to create an account and provide certain personal information. For example, when registering as a user for Services, we may ask for your name, e-mail address, birth date, mailing address, zip code, phone number, credit card information, or other personal information. We may also collect information that you provide directly to use by voluntarily filling in forms on the Platform, including transactional information or customer service information.
When you browse our Platform or use any of our Services, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. We may also use “cookies” and other tracking technologies to enhance your experience and gather information about our Platform visitors. If necessary to perform the Services, we may collect PHI. Any collection, use, or transmission of PHI will be in accordance with applicable laws.
How Do We Use Your Information?
We may use the Information we collect from when you use the Services to:
- provide you with services or information that you request from us;
- provide treatment and other services to you–for example, to provide telehealth consultations or to consult with your physician about your treatment plan;
- for our operations, which include internal administration and planning and various activities that improve the quality and cost-effectiveness of the services that we deliver to you.
- verify your identity in connect with account creation;
- notify you about changes in the Services we offer;
- allow you to participate in any interactive features on the Services;
- personalize your Services;
- contact you when necessary or requested;
- process transactions via a third-party payment processor;
- send you communications to inform you of special events, programs, or other offers;
- send you information about Futsi Therapy or our Services, including by letter, email, text, telephone, or other forms of communication (to the extent you have not opted out of receiving marketing communications);
- provide you with information about third-party businesses, products, and services, including by letter, email, text, telephone, or other forms of communication (to the extent you have not opted out of receiving marketing communications);
- troubleshoot problems with the Services, as requested;
- enforce the Terms of Service, and to detect and protect against error, fraud, and other unauthorized or illegal activities;
- operate and improve the Services available through us;
- evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which your Information held by us about our consumers is among the assets transferred.
How We Use Cookies
We use cookies (small text files stored in your browser) and other techniques such as web beacons (small, clear picture files used to follow your online activities) (“Tracking Technologies”). Tracking Technologies collect information that tells us how you use our Platform, web-related products and Services. The use of Tracking Technologies does not give us access to the rest of your computer.
This, in turn, helps us make our Services relevant to your interests and needs. We use a number of different Tracking Technologies, including functional, performance, advertising, and social media or content cookies. While we use cookies and pixel tags, we do not track our users across websites or over time.
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:
- Tracking Technologies and Advertising. Most browsers accept cookies automatically. You may be able to set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. For instructions, check your browser’s technical information. If you disable or refuse cookies, please note that some parts of this Platform may then be inaccessible or not function properly. However, you can still place orders over the telephone or by contacting customer service. Please note that cookie-based opt-outs must be performed on each device and browser that you wish to have opted out.
- Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can always opt-out by logging into the Platform and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an e-mail stating your request to isabelle@futsitherapy.com.
- Promotional Offers from the Company. If you do not wish to have your e-mail address/contact information used by the Company to promote our own or third parties’ products or services, you can opt-out by clicking the unsubscribe link in the promotional email. This opt-out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience, or other transactions.
- Targeted or Interest-Based Advertising. We may work with third-party advertising companies that collect and use information about your online activities across sites over time in order to deliver more relevant advertising when you are visiting the Platform and elsewhere on the Internet. This practice is known as interest-based advertising. The online advertising industry also provides websites from which you may opt-out of receiving targeted ads from our advertising partners that participate in self-regulatory programs. Note that electing to opt-out will not stop advertising from appearing in your browser or applications. It may make the ads you see less relevant to your interests. - Google Analytics. We may use Google Analytics to improve our Platform’s functions. You can choose not to be included in Google Analytics by visiting https://tools.google.com/dlpage/gaoptout.
“Do Not Track” Request
Our Services currently do not respond to “do not track” or similar signals.
How Do We Share Your Information?
We do not sell or rent your Information collected through the Services to anyone.
We may also disclose your Information as follows:
- with your health care or other service providers to assist in the providing of services;
- to a family member, other relative, a close personal friend, or any other person identified by you when you are present for, or otherwise available prior to, the disclosure if: (1) we obtain your agreement or provide you with the opportunity to object to the disclosure and you do not object, or (2) we reasonably infer that you do not object to the disclosure. If you are not present for or unavailable prior to a disclosure (e.g., when we receive a telephone call from a family member or other caregiver), we may exercise our professional judgment to determine whether a disclosure is in your best interests;
- with contractors, service providers, and other third parties we use to support our business;
- to fulfill the purpose for which you provide it;
- for any other purpose disclosed by us when you provide the information;
- with your consent;
- to the extent legally permissible, we may also disclose your Information to your health care service providers for purposes of medical treatment, consultation, appointment reminders, to disclose your use of the Services, and to deliver content specific to your health condition.
- to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which your Information held by us about the Platform users is among the assets transferred;
- to enforce any agreement, including any applicable terms of service;
- to establish or exercise our right to defend against legal claims;
- to law enforcement and other government authorities such as legislatures, courts, agencies and litigants if we reasonably believe that such action is necessary to: (a) comply with the law and the reasonable requests of governmental authorities; (b) comply with legal process; (c) respond to requests from public or government authorities, including public or government authorities outside your country of residence; (d) protect the security or integrity of the Services’ information systems; and/or (e) exercise or protect our rights, privacy, safety or those of affiliates, clients, you or others; and
- if we reasonably believe disclosure is necessary or appropriate to protect the rights, property, or safety of Futsi Therapy or others.
How Do We Protect Your Information?
To protect your Information, we take commercially reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed. However, no data protection procedures are entirely infallible. As a result, while we strive to protect your Information, we cannot guarantee that it will be 100% secure. Your transmission of your data to our Platform thus is done entirely at your own risk.
Third-Party Websites
The Platform may contain links to other websites, including those of third parties or business partners. While we seek to link only to websites that share our high standards and respect for privacy, we cannot be responsible for the privacy practices other websites use. By accessing other third-party websites or applications through our Services, you are consenting to the terms and privacy policies of those websites. It is possible that other parties may collect information about your online activities over time and across different websites when you use our Services.
Age of Consent
In accordance with the Children’s Online Privacy Protection Act (“COPPA“) and other US state laws, our Services are not marketed to children under thirteen (13) years of age, and you may not sign up for our Services if you are under 13 years of age. If you learn that a child under the age of 13 has created an account with Futsi Therapy, please contact us at isabelle@futsitherapy.com.
Notwithstanding the foregoing, a parent or legal guardian of a child may share the child’s Information with Futsi Therapy to provide them with care coordination of services. We ask that Information about children under the age of majority not be provided to Futsi Therapy without the prior consent of the child’s parent or legal guardian. By providing the Information of a child under the age of 13, you are affirming that you are legally authorized to provide such Information.
California Visitors
California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Platform that are California residents to request certain information regarding our disclosure of your Information to third parties for their direct marketing purposes. International Visitors
Our Services are hosted and operated in the United States. Unless you have been informed otherwise, by using the Services, you are consenting to the transfer of your Information to the United States. If you are accessing the Services from outside of the United States, please be advised that United States’ law may not offer the same privacy protections as the laws of your jurisdiction.
Changes to this Privacy Policy
We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Platform. If we make material changes to this policy, we will notify you here that it has been updated so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
